This Privacy Policy (this “Privacy Policy”) of Zipcard, Inc. a Delaware corporation (“ZipCard” or “we” or “us”), describes your privacy rights regarding our collection, use and disclosure of information that you may provide to us via your use of the WeLocals.com website, the zipcarded.com website, the myzipcard.com website, the zipcard.nyc website or ZipCard’s other websites and mobile applications that link to or reference this Privacy Policy (collectively, the “Site”), or the services, features, content and applications accessed through the Site (collectively with the Site, the “Service”). Please be sure to read this entire Privacy Policy before using or submitting information to the Site or the Service.

 

This Privacy Policy applies to all users of the Service, including, without limitation, users who browse the Service; users who participate as members in the Service’s loyalty reward program (each, a “Member”); and businesses and other entities (each, a “Business”) that offer their goods and/or services as participating businesses in the Service’s loyalty reward program.

 

This Privacy Policy may be available in multiple languages on the Site; in the case of a conflict between any other language version and the English language version, the English language version shall always control.

 

What information do we collect, and what do we use your information for?

 

We collect and store information about you that you enter on the Service or provide to us in other ways, including:

 

  • your account information;
  • information you provide when you sign up for our ZipCard e-mail network;
  • information you provide when you participate in our online surveys;
  • content you contribute through the Service;
  • messages you send through the Service to other users;
  • information you provide when you make purchases through the Service; and
  • information you provide when you initiate any other transactions through the Service

 

Any of the information we collect from you may be used in one or more of the following ways:

 

  • to provide the Service’s functionality;
  • to personalize your experience;
  • to track your usage of the Service;
  • to display relevant advertising;
  • to market the Service;
  • to provide feedback to Businesses that participate in the Service;
  • to respond to your inquiries, provide customer support, and fulfil your requests;
  • to improve the Service;
  • to message you and to send periodic emails, for example, to provide you with information about the Service or about changes to the Service; or
  • to comply with legal obligations

 

Our collection and use of information depends in part on how you use the Service. In this regard, please note the following:

 

Account Information: If you create an account with the Service, we may store and use your full name, email address, postal address, date of birth, and other information you may provide with your account. Your first name and last initial, email address as well as any photo you submit through the registration process, may be publicly displayed as part of your account profile.

 

Public Content: Some of the content that you contribute through the Service is intended for public consumption, including:

 

  • your photos and videos;
  • your ratings, reviews, favorites, comments, likes and bookmarks;
  • messages to other users; and
  • if you are a Business, information you provide in connection with your business listing (“Business Listing”)

 

We may display this public content through the Service, share it with Businesses, and further distribute it to a wider audience through third party sites and services.

 

Contacts: You can invite your friends to join the Service by providing us with their contact information. We may store that contact information long enough to process your invitations.

 

Communications: When you sign up for certain features of the Service, you are opting to receive messages from us, other Members, Businesses, and unaffiliated third parties that offer products and services. You can manage some (but not all) of your messaging preferences. We may also track your actions in response to the messages you receive from us or through the Service, such as whether you deleted, opened, or forwarded such messages. If you exchange messages with other users through the Service, we may store them in order to process and deliver them, allow you to manage them, and we may review and disclose them in connection with investigations related to the operation and use of the Service. We may not deliver messages that we believe are objectionable, such as spam messages. We may also store information that you provide through communications to us, including from phone calls, letters, emails and other electronic messages, or in person. If you are a Business, we may contact you, including by phone or email, using the contact information you provide us or that we have on record for you.

 

Transactional and Promotional Information: If you are a Member and register a purchase at a Business through the Service, we may collect and store information about you, such as your name, address, and email; the purchase price; your use or redemption of, or your acquisition of, Store Offers, Store Points, Store Vouchers, Local Bucks or Local Coins (each as defined in the Terms of Service); and any other information you provide to us. We collect and use this information in order to process your acquisition or redemption of Store Offers, Store Points, Store Vouchers, Local Bucks or Local Coins.

 

In addition, after you elect to participate in the loyalty reward program of a Business, which you do by either accepting an initial introductory offer by that Business, or clicking to participate in the loyalty reward program of that Business where this option is presented to you, we may then share with that Business your account information and your purchase and redemption activity with respect to products and services purchased from that Business. We may then also deliver to you special offers, discounts, rewards, and push notifications from that Business. We give you the opportunity, using the account management feature of the Service, to opt-out of (unsubscribe to) receiving such communications from Businesses in whose loyalty reward programs you participate.

 

We do not disclose your transactional information to third parties, other than the applicable Business, for the purpose of marketing their products or services to you unless you first agree to such disclosure.

 

If you are a Business and validate a purchase made by a Member through the Service, we may collect and store information about you, including the purchase price and the redemption of any Store Points, Store Vouchers or Local Bucks, as well as any other information you provide to us, in order to facilitate your participation in the Service and to allow us to calculate your monthly charges for participating in the Service.

 

Activity: We may store additional information about your use of the Service, such as your search activity, the pages you view, the date and time of your visit, and businesses you call using our mobile applications. We also may store information that your computer or mobile device provides to us in connection with your use of the Service, such as your browser type, type of computer or mobile device, browser language, IP address, mobile carrier, phone number, unique device identifier, advertising identifier, location (including geolocation, beacon-based location, and GPS location), and requested and referring URLs. You may be able to disallow our use of certain location data through your device or browser settings.

 

Beacon-Based Location Information: If you are a Member and visit the premises of a participating Business, the Service may collect non-personally identifiable information about your location through the use of iBeacon technology, an indoor positioning system that can notify nearby mobile devices of their presence. We use the iBeacon technology to detect the presence of a mobile device at the premises of a participating Business and to trigger your ability to register purchases made at that Business. We install one or more iBeacon-compatible hardware transmitters (each, an “iBeacon”) on the premises of each participating Business, and the installed iBeacons transmit location and time data to an application installed on your mobile device.

 

From the non-personally identifiable information collected by the iBeacon technology, we store a User ID corresponding to your mobile device and number of visits linked to that User ID. We share, with participating Businesses, analytics data generated from such stored information.

 

Registration of purchases made through the Service requires the transmission of such  location and time data using the iBeacon technology. If you do not want the Service to collect and store your location and time data through the use of iBeacon technology, you can choose to turn off your Bluetooth when visiting participating Businesses. However, you will not be able to register qualifying purchases made through your participation in the Service unless you have your Bluetooth turned on.

 

To improve the operation of the Service, we may also collect other information besides location and time data through our use of the iBeacon technology, including the strength of the signal between the iBeacon and the mobile device, the lengh of time the mobile device is near the iBeacon, or the battery level of the iBeacon itself.

 

How do we protect your information?

 

We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it, by storing personal information on a secure, password protected server, and by limiting access to your personal information to authorized personnel. However, no method of transmission over the Internet or via mobile device, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

 

Do we use cookies?

 

Yes. We, and third parties with whom we partner, may use cookies, web beacons, tags, scripts, local shared objects, advertising identifiers and similar technology ("Cookies") in connection with your use of the Service. Cookies may have unique identifiers, and reside, among other places, on your computer or mobile device, in emails we send to you, and on our web pages. Cookies may transmit information about you and your use of the Service, such as your browser type, search preferences, IP address, data relating to advertisements that have been displayed to you or that you have clicked on, and the date and time of your use. Cookies may be persistent or stored only during an individual session.

 

We may use Cookies to allow the Service to work as intended, for authentication and security purposes, to remember your preferences about the Service’s functionality, to manage the display of notifications from us to you, to make advertising more relevant to you and other users and more valuable to advertisers, and to help us track an analyze how you and other users use the Service.

 

If you do not wish to have session Cookies placed on your device, you may be able to disable some (but not all) such Cookies through your device or browser settings, but doing so may affect the functionality of the Service. The method for disabling session Cookies may vary by device and browser, but can usually be found in preferences or security settings.

 

To whom do we disclose your information?

 

Third parties may receive information about you as follows:

 

Businesses: See ”What information do we collect, and what do we use your information for? – Transactional and Promotional Information” above for a description of our disclosure of your information to participating Businesses.

 

Advertisers: We may allow third parties to use Cookies through the Service to collect the same type of information for the same purposes as ZipCard does for itself. Third parties may be able to associate the information they collect with other information they have about you from other sources. We do not necessarily have access to or control over the Cookies they use. Additionally, we may share non-personally identifiable information from or about you with third parties, such as location data, advertising identifiers, or a cryptographic hash of a common account identifier (such as an email address), to facilitate the display of targeted advertising. You may be able to limit our sharing of some of this information through your mobile device settings, as described under ”Do we use cookies?” above.

 

Service Providers: We may rely on third party providers to support or provide some of the services that are available through the Service. We may also rely on third party providers to perform certain services for us in connection with your use of the Service, such as communications and hosting services, network security, technical and customer support, tracking and reporting functions, quality assurance testing, payment processing, our own marketing of the Service, and other functions. We may share information from or about you with these third party providers so that they can perform their services or complete your requests. These third party providers may share information with us that they obtain from or about you in connection with providing their services or completing your requests.

 

Aggregate Information: We may share user information in the aggregate with third parties, such as advertisers and content distributors. For example, we may disclose the number of users that have been exposed to, or clicked on, advertisements.

 

Business Transfers: We may share information from or about you with our subsidiaries, joint ventures, or other companies under common control, in which case we will require them to honor this Privacy Policy. If another company acquires us or all or substantially all of our assets, that company will possess the same information, and will assume the rights and obligations with respect to that information as described in this Privacy Policy.

 

Investigations: We may investigate and disclose information from or about you if we have a good faith belief that such investigation or disclosure (a) is reasonably necessary to comply with legal process and law enforcement instructions and orders, such as a search warrant, subpoena, statute, judicial proceeding, or other legal process served on us; (b) is helpful to prevent, investigate, or identify possible wrongdoing in connection with the Service; or (c) protects our rights, reputation, property, or that of our users, affiliates, or the public. If you flag or otherwise complain to us about content through the Service, we may share the substance of your complaint with the contributor of that content in order to provide an opportunity for the contributor to respond.

 

Links: The Service may contain links to unaffiliated third party services. Except as set forth in this Privacy Policy, we do not share your personal information with them, and are not responsible for their privacy practices. We suggest you read the privacy policies on or applicable to all such third party services.

 

Facebook and Twitter:  Please note that if you interact with Facebook, Twitter, or other third party icons through the Service, including "Like," "Share," or similar buttons, those companies may collect information about you, such as your device’s IP address. Your interactions with these and other third parties are governed by the third parties’ privacy policies.

 

Controlling your Personal Data

 

Please note that the messages you send or receive using the Service are only private to the extent that both you and the person you are communicating with keep them private. For example, if you send a message to another user, that user may choose to publicly post it. Also, we may access and disclose such messages in the course of investigations relating to use of the Service.

 

Account Termination

 

In the event that you close your account with the Service, we may remove your public posts from view and/or dissociate them from your account profile, but we may retain information about you for the purposes authorized under this Privacy Policy unless prohibited by law. For example, we may retain information to prevent, investigate, or identify possible wrongdoing in connection with the Service or to comply with legal obligations.

 

Children

 

The Service is intended for general audiences and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information without parental consent, we take steps to remove such information and terminate the child's account.

 

Use of the Service Outside the United States

 

The Service is hosted by servers in the United States. Accordingly, if you are located outside of the United States, the personal information you provide to us will be transferred to the United States. By submitting your personal information, you consent to its transfer and storage in the United States and its use in accordance with the purposes for which it was originally collected.

 

Changes to our Privacy Policy

 

We may revise this Privacy Policy from time to time, and if so we will post the revised Privacy Policy on the Site. If we make material changes to this Privacy Policy, we will post a notice on the Service that this Privacy Policy has been modified and provide a link to the revised Privacy Policy. By continuing to access or use the Service after those changes become effective, you agree to the revised Privacy Policy.
